A Landlord may undertake Cat B works rather than allowing the tenant to do this. The Works and Buildings Payment Act 1949 does not prevent this, but landlords are advised to consider carefully whether to charge tenants for works that could be regarded as part of their obligations under a lease. But if the tenant had to pay for the works, as with other Cat A items, the landlord could not deduct the payment from its market rent.

The question is then what is required in order for such a proactively taken step to fall within the spirit and intention of TDS. In this article we consider a number of relevant factors when considering whether an OTT will be applied.
A new Section 32IA(6) of the Landlord and Tenant Act 1987 (the Act)( per the version as amended on 28 November 2012 ) provides that an OTT will not be disapplied if there is a change of tenancy and one or more tenants pay for works that form part of the relevant tenant’s capital item (Cat C or Cat D works). The new provision, which was introduced as a result of the Localism Act 2011 , has been in force since 28 November 2012.
If the tenant carries out Cat B works, but only provides the landlord with evidence of 35% NDS they have paid, the OTT will not be disapplied. This is because even if a tenant pays towards part of its own works, it is still using its own money to pay. This article is for the landlord who has a tenant paying for their own Cat B works (as defined in paragraphs 3 and 4). These works are not statutory items and, therefore, require a direct payment from the tenant to the contractor. This article looks at why this arrangement can be problematic and how you may be able to mitigate the effect of this arrangement on your property business. The law requires that one of the conditions of an OTT is that it can only be granted where the tenant agrees to pay the landlord/agent for any 'qualifying works' (Cat B works) and for a reasonable share of other qualifying works (Cat C works).
This means that if the tenant pays for any qualifying works, the OTT cannot be used. OTT is an abbreviation for excluded tenancy payment. A tenant can pay for repairs and maintenance to be carried out if it has been recorded as a repair and maintenance item in a general repair covenant or in the tenancy agreement. If tenants pay for any unrecorded Cat B works, these payments remain OTT. This means that if a landlord pays for works (Cat B works) and rents the property out again as part of a mixed tenancy, the OTT will not be disapplied.
This is because the tenant in this situation became a tenant under a direct arrangement with the landlord rather than a broker or agent. If a tenant “makes good” its own works, which are part of its Cat B, and lends to the landlord the money to pay for those works, then an OTT will not be applied to that sum.
