Some good news for skip hire customers from 1st July this year, the Environment Agency for England is going to be switching from Waste Transfer Notes (WTN)to Waste Accreditation and Tracking System (Skip Hire UK ) as a record of waste transfer. This means that all waste companies now have one year in which to familiarise themselves with the new system. In support of the forthcoming changes to environmental legislation that will provide an option for electronic recording and reporting of waste transfer data, Landcare Research has created a new Excel based tool that can be used to electronically create and submit WTNs.

The first of the five things you need to know about Waste Transfer Notes is that prior to 2003 they were required to be written (and signed) on paper and placed in a recording medium in many states. The regulatory change is part of the latest batch of measures designed to make skip waste disposal safer for workers and the public. The changes were agreed as part of a consultation with industry in summer 2016. In Commerce, Waste Transfer Notes (WTNs) are a record of money that is credited to the generator of a given waste stream for providing treatment to the waste. A generator is a company that produces and generates waste on their own premises.

This credit can happen in two ways. The Canada Waste (Metalliferous) Regulations, 2016 now accept photos or videos of the materials contained in the skip as a record. The skip operator can include this written record at time of delivery. A Skip Hire UK had to be given in writing between the person who generates the waste and the person who receives it, at or before the time of transfer. But in 2015, the Skip Hire UK (Transfer and Disposal) Regulations came into force   abolishing WTNs as well as introducing a number of other changes.

Waste Transfer Notes were a statutory requirement of the Environmental Protection Act 1990 (EPA 1990) and licensed waste carriers had to keep copies for a period of two years. However, section 64A of the Environment Act 1995 (EA 1995) effectively made WTNs redundant from 1 August 2000. From March 2001, WTNs could no longer be issued by local authorities. The Skip Hire UK Regulations have been subject to almost constant revision and amendment since their inception in 1996.    The changes have been so frequent that the Environmental Protection Act 1990 (Part 5), the legislation which provides the statutory framework for waste management, is now over 1,000 pages long.

Prior to the changes made by the Waste Regulations in 2015, your skip business transaction could mean either you or your client were committing an offence under Section 33 of the Environment Act 1995. But a new Government legislation, the Transfrontier Shipment of Waste (England & Wales) Regulations 2012, came into force on October 1 2012, which rendered that written transfer note obsolete. But the WTN is now being replaced by the Skip Hire UK and Site Waste Information (WTI) which come together, in a new format known as the Waste Transfer & Collection note.     This is part of a move to make record keeping easy, accurate and fit for purpose.  More on that later…. Odd as it may sound, a WTN is a written document that conveys the responsibility for managing the skip and associated waste to the skip hire company.

This written record of where the skip is being placed has to be kept for three years and can be requested by anyone. Colorado House Bill 111340  signed into law on May 1, 2013, eliminates the requirement for a WTN when a waste hauling company transports certain construction and demolition waste to a permitted solid waste disposal facility. A lot has changed since the Waste Transfer Note (WTN) was introduced. Today, there are so many other means by which waste, and in particular Construction and Demolition (C&D) waste can be documented and tracked.

That was because waste movements between businesses or indeed from one business to a waste transfer station could only be completed via a WTN, which did require an attendant 'paper trail'.
